| Very good, I used to work for them but left as it was all about money and YES we were set targets. Nice to see that the image used on the Park Wise www.parkwise.org.uk website is in fact a vehicle not breaking any contravention as the lines are broken!

| As anybody or do you know of anybody, who as received a parking ticket that looks like the original one i've attached. If so it is invalid and void, as no date of issue is no the face on the ticket. It's on the detachable payslip. This original ticket follows the Department Of Transport guidelines on the wording. However at the top of the ticket are the words 'Road Traffic Act 1991', and under section 66 (3)(c) of this act. It states 'That the penalty charge must be paid before the end of the period of 28 days beginning with the date of the notice', AND IT DOESN'T. Only the (alleged) offence date is shown not the issue date, therefore it is invalid and void. To top that Burnley Council along with every local authority who operate Decrimilised Parking Schemes, were advised that the wording was incorrect in MAY 2005. As far as i'm aware they still to this day issue these invalid tickets to the motorist. As you can see from the council copy i was sent, the date of issue has miracously appeared, but err they can't even doctor it correctly as it still doesn't state 'payable from date of issue' Below is a link to a story in the Burnley Express on 3rd March. There will be a follow up story appearing shorly. If anyone has received a ticket worded like the one attached, or any ticket come to that. | i have had 4 tickets this year, all off the old leos car park, always buy a ticket and in all four cases ticket fell on dashboard but clearly visable which i pointed out in one case to the grey gestapo, but he ignored me. anyway appealed and had all of my arguments accepted, but how many people just pay up without a fight? |

| That's the problem. Most don't appeal and if they do and the council reject it, they think they got to pay. Appeal again and it goes to another organisation.

| Is this organisation the National Appeal and Adjudication Service (NPAS)? The independent and impartial tributal service that under section 6 of the 1998 Human Rights Act, you are required to have heard any CIVAL/& or CRIMINAL actions against you. Is this the same independent & impartial tribual service that is part funded to the sum of 0.60p by the local authority pursuing the PCN? Not really independant & impartial when their very existence relies on them rejecting as few appeals as possible. |

| Someone was supposed to be setting up their own service to help others get their tickets cancelled, this site is still being developed but nothing changed for months: www.parkwiser.co.uk He's an estate agent on Standish Street I think.

| Can you scan your ticket and mail it to me at: n_corless@hotmail.com As i'd very much like to take at look at it, and check the legality of it. That's the 1st line of defence. There is another defence consisting of 3 points of law (if you've got the b**** to follow it through) which I think every motorist should be made aware of. |

| The estate is called Howard Baker or Barker, and off the top of my head it's called Falcon Foxglove I think. He stated his goal was to rid the streets of Burnley of Parkwise. But i've looked at his Parkwiser website and it no nearer completion now than it was then, and that is last summer. It's now Spring. |

| Thanks for the advice. I am new to forum. I got another ticket on Tuesday. I work in Nelson and move my car three times a day - every 2.5hours so I don't get a ticket. I stupidly put the time of arrival as 2:30pm and not 1:30pm (busy day!) but moved the car at 4:00pm as I had set my alarm on the phone to move it after 2.5 hours from arrival (at 1:30pm). The sign on the car park (Stanley Street) reads it is an offence to set a FALSE time on your disk. I did not set a false time - this surely means someone who intentionally sets out to dishonestly set a time in advance to try and get a longer stay on the car park ?. I genuinely screwed up - I did not set a FASLE time. Surely it is unfair to be fined for this ?. I have appealed - not expecting a positive outcome - past appeals refused point blank (save for one where I was prepared to go to court to argue the toss over the circumstances). |
