There's more than meets they eye in this case of the 10 year old who looked 16. None of us have seen her so we don't know how old she looked but even the prosecution admitted she looks 16.
The defendant claims she initiated sex so that wouldn't make it rape. Without knowing all the details it's impossible to judge but I'm just looking at it from the point of view of a guy who meets a girl who appears to be at least 16 and she gives him the come on and they have sex.
Up to that point he believes he's had consensual sex with a girl of legal age. Suddenly he finds himself in the position of having had sex with a 10 year old who is then claiming she was raped.
